Terms and Conditions of Use
1. Identification of the Owner
The website www.firescalemodeler.com is owned by Marco Teodoro, operating as a Sole Trader (ENI), with fiscal domicile at Rua dos Moleiros, Lote 14 - Varatojo 2560-237 Torres Vedras - Portugal, holder of VAT number (NIF) PT207470898, hereinafter referred to as "Fire Scale Modeler" or "Seller".

2. Scope and Object
These General Conditions regulate the terms and conditions governing the provision of services and sale of products by Fire Scale Modeler. By validating an order, the Customer expressly accepts these terms.
3. Products and Prices
3.1. Nature of Products: The products sold (paints, varnishes, solvents, additives) are of a technical nature, intended exclusively for static modeling and professional use. They are not toys. 3.2. Prices: All prices indicated include VAT at the legal rate in force (where applicable). 3.3. Images: The images on the website are illustrative. Due to the color calibration of different screens, the actual color of the paint may differ slightly from that shown on the monitor. Fire Scale Modeler does not accept claims based exclusively on this digital visual discrepancy.
4. Ordering and Payment
4.1. Fire Scale Modeler offers the following payment methods: Paypal, Credit Card, Bank Transfer, Stripe, MBWay, MB, Klarna. 4.2. The order will only be processed after payment confirmation. 4.3. In the event of a stock shortage after payment, the Customer will be contacted to choose between a product replacement or a full refund.
5. Pre-Orders
5.1. Products marked as "Pre-Order" are items that are not in immediate stock and whose production or supplier order is triggered by the Customer's purchase. 5.2. Cancellation: Unlike personalized custom-made products, the Customer has the right to cancel a pre-order and request a full refund at any time before the order is shipped.
6. Shipping and Customs
6.1. Delivery times indicated are estimates. 6.2. Customs and Duties (Non-EU Countries): For orders sent outside the European Union (e.g., USA, UK, Brazil, Canada), the Customer is the sole entity responsible for paying any customs duties, import taxes, or administrative costs in the destination country. Refusal to pay these fees by the Customer does not grant the right to a refund of shipping costs in the event of a return.
7. Liability and Safety (IMPORTANT)
This clause defines the limits of Fire Scale Modeler's liability regarding the use of its chemical products.
7.1. Professional Use: The products are intended for adult users. The Customer acknowledges that paints and solvents contain chemicals that require the use of Personal Protective Equipment (PPE) such as masks, gloves, and safety goggles, as well as adequate ventilation. 7.2. Mandatory Testing: Fire Scale Modeler cannot control application conditions, humidity, temperature, or the nature of the Customer's materials (plastics, resins). It is the Customer's obligation to perform a preliminary test for compatibility on a safe area or scrap piece before applying the product to the final model. 7.3. Limitation of Liability: Fire Scale Modeler's liability is strictly limited to the purchase price of the product. The brand is not responsible for:
- Damage, deformation, or adverse reactions on kits, models, or parts (e.g., "melted plastic").
- Incompatibilities resulting from mixing with products from other brands.
- Damage to equipment (airbrushes, tools) due to misuse or improper cleaning. 7.4. By purchasing, the Customer accepts that the use of the product is at their own sole risk and responsibility.
8. Legal Warranty
In accordance with current legislation (DL n.º 84/2021), products have a 3-year conformity warranty. Exclusion: The warranty does not cover consumable products (paints, glues, thinners) that have been opened, used, or incorrectly stored by the Customer (e.g., dried paints due to a poorly closed lid or exposure to sunlight).
9. Right of Withdrawal (Returns)
9.1. The Customer has the right to return the order within 14 calendar days from receipt, without the need for justification. 9.2. Hygiene and Safety Exception: In accordance with the law, returns of sealed products that have been opened after delivery are not accepted, for reasons of health protection and safety (risk of chemical degradation or contamination). 9.3. The Customer bears the return shipping costs. The refund will be issued after verifying the condition of the products.
10. Dispute Resolution
In the event of a dispute, the consumer may resort to an Alternative Dispute Resolution (ADR) Entity in their area of residence or access the European Commission's ODR Platform.
